“엠네스티, 북한 인권이나 신경 써라”

‘사이버안보감시단 블루아이즈’(http://cafe.naver.com/iblueeyes)가 국가보안법을 문제 삼는 일부 국제인권단체들에게, 그들의 주장을 반박하는 항의서한을 보냈다.

블루아이즈는 “종북좌익세력들이 국가보안법 무력화를 위하여 ‘허위 선전-선동’ ‘인권 유린’ 등으로  매도하는 등 다양한 시도를 하고 있다”며 “이들은 트위터나 각종 게시물 등을 통하여 안보수사기관이 ‘공권력탄압’ ‘인권유린’ 등을 하는 것처럼 여론을 호도하면서 언제나 진실을 숨겨 왔다”고 비판했다.

블루아이즈는 또 엠네스티 한국지부에 대해 “인권의 편이 아니라 인권을 빌미로 한 종북주의 노선을 추종하는 집단이 아닌가”라고 묻고 “이들이 주장하는 국제기준이 북한의 기준인지, 북한이 요구하는 기준인지 궁금하다”고 공박했다.
 
블루아이즈는 “Amnesty International(앰네스티 본부), Human Rights Watch(휴먼와치), 유엔인권고등판무관 등 총 12개소에 한국의 국가보안법의 정당성 등에 대해서 설명하는 내용과 그들의 잘못을 지적하는 항의서한을 발송 했으며, 지속적으로 이를 개선시키기 위한 활동을 할 것”이라고 강조했다.
 
다음은 블루아이즈가 국제 엠네스티 대표 등에 보낸 항의서한 전문이다.
 
Dear the representatives of the Amnesty International, the Human Rights Watch, and the UN High Commisioner for Human Rights.

We are "Cyber Security Guard-The Blue Eyes", Non-Governmental, Korean Netizen Association who work for protection of the liberal democracy and the constitution in the Republic of Korea, and the improvement of the North Korean's Human rights.
저희들은 자유대한민국의 헌법 및 자유 민주주의수호, 북한인권개선을 위하여 활동하는 한국의 네티즌 시민 단체인 “사이버안보감시단 블루아이즈” 입니다
 
We really appreciate for improving human rights all around the world including the Republic of Korea, ROK.
귀 단체 덕분에 전 세계를 비롯한 대한민국의 인권 개선에 대해 진심으로 감사를 드립니다.
 
But we're concerned about your recommendation of abolishing the National Security Law, so we have a favor about reconsidering your people who sent a report abolishing National Security Law.
하지만 귀 단체에서 한국에 대해서 “국가보안법” 폐지 등을 권고하는 행동들을 취하고 있음에 저희는 깊은 우려를 표합니다. 때문에 한국의 국가보안법 폐지 보고서를 올린 귀하의 조직의 관계자들에 대해서 정확하게 재조사 해주실 것을 당부 드립니다.
 
Korea is the last place where there is a possibility to break out the war between the Liberal Democrats and the Communists. We Korean people are still living in high-risk threat for communization of North Korea. You should remember two cases, 'Cheonan sinking' and 'Bombardment of Yeonpyeong'.
한국은 현재 자유 민주주의와 공산주의 북한의 이념 대립의 마지막 장소이며 아직까지도 한국 국민들은 공산주의의 무력 침략 위협 속에서 살아가고 있습니다. 최근에도 북한에 의해서 자행된 “천안함 사건”, “연평도 포격” 등을 기억하실 겁니다.
 
And North Korea is threating the peace of the world by the producing counterfeit dollar, manufacturing and exporting weapons of mass destruction and drugs, and North Korean people fear and starve to death, without minimum human rights guarantee.
또 북한은 현재 마약 제조 및 판매, 위조 달러 제작, 대량 살상무기 개발 및 수출로 세계 평화를 위협하고 있습니다. 그리고 북한 주민들은 최소한의 인권 보장도 없이 고통 받고 굶주려 죽어가고 있습니다.
 
National Security Law is the corner stone to keep the liberal democracy in the Republic of Korea, and it is the law to punish and to restrict people who are supporters and spies by North Korea trying to assassinate prominent people of the ROK, strike terror, and cause confusion in society to make the Republic of Korea a communist state.
아직까지도 북한은 대남적화야욕을 포기하지 않은 채 한국 내에 암약하고 있는 간첩이나 협력자 들을 통해서 “사회혼란” “요인암살” “테러” 등을 자행하고 있는 현실에서 이들을 규제하고 처벌하는 법이 한국의 자유민주주의를 지키는 핵심인 “국가보안법”입니다.  
 
Even though you recommend that the ROK government abrogate National Security Law, it is not the law to offend freedom and idea of individual in Korea. That is the law prescribed by the constitution of Korea in amendment 37 which precedes the basic human rights to ensure freedom of conscience, knowledge and publishing. 
귀 단체에서 폐기를 권고 하는 것처럼 국가보안법은 결코 건전한 사상과 양심의 자유를 침해하는 악법이 아닙니다. 대한민국 헌법에서는 기본적으로 양심의 자유, 학문의 자유, 언론 출판의 자유 등을 보장하고 있으면서도, 제37조 2항 에서 유보조항을 두어 국가안전보장, 질서유지 및 공공복리를 위하여 필요한 경우에는 이들 기본권을 제한할 수 있다고 규정하고 있습니다.
 
Although the Constitution of the ROK accepts the freedom of variety, ideology and conscience, it doesn't mean that tolerating negates and destroys the Liberal Democracy, National Polity of the ROK. So National Security Law was established.
대한민국 헌법은 사상과 양심의 자유를 인정하고 있습니다. 하지만 국가 체제인 자유 민주주의 그 자체를 부정하고 파괴하려는 사상과 양심을 용인하는 것은 아닙니다. 바로 국가보안법이 이 때문에 제정됐습니다.
 
No country tolerates to destroy national polity. Thus, Most people of the ROK who don't negate national polity and who don't want national polity to be destroyed are not violated their freedom.
세계 어느 나라도 자기나라의 국체를 위협하거나 전복하려는 사상을 용인하지 않고 있습니다. 따라서 대한민국을 부정하고 체제를 전복하려는 사상을 갖지 않는 대다수의 선량한 국민들은 자기 사상이나 양심의 자유를 전혀 침해받지 않는 것입니다.
 
At present, There are no conscientious prisoners who violate National Security Law in ROK. And the Amnesty defines a conscience;『who didn't use violence or advocate violence 』
현재 대한민국은 “국가보안법” 으로 인한 양심수가 존재하지 않습니다. 또 국제사면위원회(엠네스티)는 양심수를 『폭력을 행사하거나 옹호하지 않았는데도 정치적․종교적 또는 그 밖의 양심에 입각한 신념을 표현했다는 이유로 세계인권선언과 국제인권규약에 위배되는 투옥․구금․육체적 억압을 비롯한 여러 형태의 구속을 받고 있는 사람』으로 정의하고 있습니다.
 
Pro-North Korean socialists, proponents of the North Korea Govt in the ROK regard the prisoners who violate National Security Law as a prisoners of conscience. But they aren't real prisoners of conscience. They just the anti-national, communist prisoners.
한국 내 친북 사회주의세력(북한의 협력자들) 들은 국가보안법 위반 사범을 양심수로 보고 있으나, 이들이 본연의 의미의 양심수가 아니라 국가보안법을 위반한 반국가사범에 불과한 것입니다. 

On February 2011, "Socialist Labor Union(SLU)", was established in 2008, was given a decision that they included 'Association for rebellion' because of National Security Law.
금년 2월에 2008년 결성된 사회주의노동자연합(사노련)이 국가보안법 상 '국가변란 선전·선동목적 단체'에 해당한다는 법원의 판결이 나왔습니다.
 
The higher court of ROK revealed a sentence this year," Socialist Labor Union which is a group for a coup d´etat and it is an association which disregards for freedom of individual and democracy guaranteed by the constitution of ROK, and it pursues to turn over the present government of the ROK with violent revolution and to rise in arms for the purpose to build a new government after it establishes a party by socialists before.
재판부는 판결문에서 "사노련의 정치적 기본입장인 '우리의 입장', '대중행동강령'과 활동 등에 비춰볼 때 사노련은 우리 헌법이 추구하는 자유민주적 기본질서를 무시하고 무장봉기 또는 폭력혁명 등 폭력적 수단에 의한 현 정부의 전복 및 새로운 정부수립을 궁극적 목적으로 하면서 그 전 단계로 사회주의 혁명정당의 건설을 1차적 목표로 하는 '정변 단체'에 해당한다"고 밝힌 바 있습니다.
 
But Catherine Baber, Asia-Pacific Deputy Programme Director of the Amnesty said, "How to threaten the national security by doing distribute printout?", as proponents of the North Korea government say. But we have our doubts about whether he discounts the truth or not.
하지만 국제앰네스티 아시아ㆍ태평양국 캐서린 베이버 (Catherine Baber) 부국장은 "사노련 회원 8명이 유인물을 나누어주는 행위가 어떻게 국가안보에 위협이 된다고 볼 수 있겠는가" 라고 북한의 협력자들이 주장하는 말과 동일하게 말합니다. 허나 저희는 그 분이 진실을 무시하고 있는 지 의구심을 품고 있습니다.

In ROK, No one shall be punished blaming the President. Rather, Someone insists "Isn't so harsh that no one be judged who blame the President?" This means ROK guarantee the freedom of expression.
한국에서는 대통령을 욕하거나 비난하여도 처벌 받지 않습니다. 오히려 사회 일각에서는 “대통령”을 욕하는데도 처벌 법규가 없는 것이 심하지 않느냐”라는 반성이 나올 정도로 한국 내에서 표현의 자유가 보장되어 있습니다.

As Catherine Baber says, "The National Security Law is incorrectly used to block the citizen who exercise freedom of expression and assembly,  and to prosecute the objectors of governmential policy. Thus, We're so concerned about what you say is same as proponents of North Korea Govt. say.
Catherine Baber가 주장한대로 "정부의 주장과 반대되는 의견을 막고 표현 및 집회의 자유를 평화적으로 행사하는 이들을 임의적으로 기소하는데 지속적으로 이용되어왔다. 따라서 더 이상의 인권침해가 일어나지 않도록 예방하기 위해 국가보안법을 폐지하거나 국제기준에 부합하도록 전면적으로 개정해야 한다." 라는 말은 북한정권의 홈피에 나와 있는 내용과 다를 바 없을 정도로 한국의 현실을 알지 못하고 보고서 몇 장으로 판단하고 주장하는 것이라 생각합니다. 저희는 이 문제의 본질에 있어서 국민들은 주장하지 아니하는데 북한의 협력자들의 말과 동일한 주장을 하는 부분에 있어서 심각한 우려를 합니다.
 
Furthermore, This is the arrogation which insisting reversal or censure the court decision, guilty.
아울러 자유민주주의 주권 국가인 한국의 사법부의 판결에 대해서 “유죄” 를 비난하고 번복되어야 한다 고 주장하는 것은 심각한 월권행위입니다.
 
And you'd better protect North Korean people's human rights rather than blaming national security law. It is more suitable for the improvement human rights all around the people of the world.
또 대한민국의 국가보안법 비난보다는 북한에 대한 인권개선에 노력해주십시오. 그것이 진정 “전 인류의 인권개선” 이라는 명제에 더 맞으며 실제적인 일이라 생각합니다.
 
Please tell them who you are protecting.
귀 단체들이 옹호하는 자들에게 한 번만 물어봐 주십시오
 
"Have you censured injustice of North Korean Goverment's existence and have you agitated for improving human rights of North Korean People? "
“정녕 그대들은 북한정권의 부당함을 규탄해보고 북한 주민의 인권에 대해 개선되기를 한 번이라도 주장을 한 적이 있는가?”
