제80차 국제펜대회, 70여 참가국 '북한인권결의안' 만장일치 채택'
  • 2014년 9월 29일부터 4일간 중앙아시아 북부에 위치한 키르기스스탄공화국 수도 비슈케크에서 “나의 언어, 나의 이야기, 나의 자유” 라는 주제로 세계문인들의 회합인 제80차 국제펜대회가 진행됐다. 참가국은 모두 70여개 나라, 300여명 대표.

    지난 2012년 대한민국 경주에서 있은 제78차 국제펜대회에서 144번째로 정식회원국이 된 ‘망명북한펜센터’(이사장: 장해성 소설가, 전 조선중앙방송위원회 기자)에서는 탈북작가로 유명한 림일 소설가와 도명학 시인이 대표로 참석했다.

    회의 마지막 날에는 본 총회에 각국 대표들이 기획한 결의안 제출이 있었으며 여기서는 ‘망명북한펜센터’가 심혈을 기울여 준비한 탈북문인들의 절절한 호소를 담은 ‘북한인권결의안’이 참가국 만장일치로 채택됐다. 다음은 ‘북한인권결의안’ 전문.

    1. 북한 인권 결의안

    조선민주주의인민공화국은 세계 최악의 폐쇄국가이다. 북한의 끔찍한 인권상황은 최근 몇 년 동안 미디어를 통해 전세계에 드러났다. 최근 수많은 북한주민들이 정권에 반하는 의견을 내놓았거나 불응한 이유로 잔인하고 비인간적인 환경 아래 탄압받고 있다.

    2013년 3월에 설립한 유엔인권이사회가 2014년 3월에 제출한 보고서는 유엔안전보장이사회가 북한의 상황을 ICC(국제형사재판소)에 회부할 것과 유엔인권고등판무관이 북한에 대한 조사에 착수할 것을 권고했다.

    보고서에 따르면 북한에서 지난 수십 년 동안 빚어진 비인간적인 인권탄압은 “북한정권이 만들어 낸 정책 하에 일어났다” 고 한다.

    북한정권에 의해 행해진 범죄에는 “몰살, 살인, 노예화, 고문, 감금, 강간, 강제낙태, 성추행, 성폭행은 물론 정치적, 종교적 및 성적 박해, 강제이주, 강제실종, 고의적인 장기적 기아와 같은 비인간적인 행태”가 포함된다. 표현의 자유에 관한 보고서의 내용을 보면 북한에서는 정권을 비판하거나 국가에 대한 불만의 목소리를 내는 것이 허용되지 않고 있으며 정부의 주도하에 엄격한 교화가 이루어지고 있다.

    유엔조사위원회가 제3국에서 만난 한 북한주민은 작가가 되려던 자신을 부모님이 어릴 적부터 어떻게 포기시키려 했었는지 털어놓았다. 왜냐하면 북한에서는 그 누구도 자유로운 글을 쓸 수 없기 때문이다. 그는 “북한에서는 김일성, 김정일 그리고 노동당을 찬양하는 내용 이외에는 그 어떤 글도 쓸 수 없다며 이를 지키지 않을 경우 체포되거나 정치범으로 몰리게 된다”고 말했다.

    언론 및 모든 정보는 정부에 의해 통제된다. 외국 라디오, 외국 텔레비전을 듣거나 보는 행위는 불법으로 간주된다. 모든 라디오는 경찰의 감시 하에 국영방송에 주파수가 맞추어져 있는지 확인된 뒤 포장되어 판매된다. 언론은 철저히 통제되고 검열되어 거대한 선전기구의 중추역할을 하고 있다.

    남한의 책을 읽는 것은 스파이 행위로 간주되어 처벌을 받는다. 중국 책 또한 금지되었다. 전화 도청은 매우 흔한 일이다. 오직 엘리트층만이 컴퓨터를 소유하고 인터넷을 사용할 수 있다. 구글 방문에 동참한 외국인 역시 인터넷을 사용할 수 있지만 북한주민의 대다수에게 인터넷 사용은 금지되었다.

    북한당국은 불시 가택수색(특히 국경에 근접한 가구들)을 통해 외국 텔레비전, 외국영화, 외국라디오 시청 및 청취에 대한 감시를 한다. 외국방송을 듣다가 걸릴 경우 장기징역형을 선고 받는다. 북한 언론 법 48조항에 따르면 정부나 정부기구에 비판적인 내용의 언급, 출판, 기사는 범죄행위로 간주된다. 북한 형법 103조에 따르면 사회질서를 심각하게 저해하는 자는 교화소에서 5년을 보내야 하며 더욱 심각한 경우 주도자는 교화소에서 10년을 보내야 한다. 남한방송을 듣거나 남한의 인쇄물 및 근거 없는 유언비어를 유포하는 일등과 같은 가벼운 범죄에도 위와 같은 엄격한 처벌이 내려진다. 하지만 더욱 끔찍한 일은 한번 교화소나 노동수용소에 들어가면 외부와 철저히 차단되며 종종 그곳에서 죽음을 맞게 된다. 석방되거나 탈옥한 사람들은 극소수로 그들의 입을 통해 수용소의 실상이 전해지고 있다.

    2. 국제PEN대회에 모인 각국 PEN센터 대표단은 북한정권에 다음과 같이 촉구한다.

    - 북한당국은 유엔조사위원회, 유엔사무총장 및 북한특별보고관의 보고서대로 북한주민의 표현의 자유를 개선하기 위한 권고사항을 준수할 것.
    - 북한주민이 평화로운 방식으로 표현의 자유를 행사할 수 있는 권리를 보장할 것.
    - 언론 자유권을 행사하다 감금된 모든 북한주민을 조건 없이 신속히 석방할 것
    - 강제노동수용소를 폐지하고, 모든 수감자들의 행방을 공개할 것.
    - 표현의 자유권 추구를 위한 근본적이고 개인적인 활동으로 문학창작을 활성화하고 문맹률을 낮출 것

    3. 국제PEN은 또한 국제사회에 다음과 같이 촉구한다.

    - 강제송환금지원칙(non-refoulement : 농르폴망원칙)을 준수하고, 반인도적 범죄를 포함한 심각한 인권유린의 상황에 놓일 위험이 있는 개인을 북한으로 송환하지 말 것
    - 북한의 상황과 주요통치자들을 국제형사재판소에 회부할 것.
    - 유엔조사위원회, 유엔사무총장 및 북한특별보고관의 보고서에 담긴 표현의 자유를 개선하기 위해 국제사회에 권고한 사항을 준수할 것.

    The Democratic People’s Republic of Korea (North Korea) is the most closed society in the world. In recent years, horrific reports have emerged ofthe brutal and inhuman treatment of hundreds of thousands of people who dared to say even one word contrary to the official received view.
    In March 2014, a report by a UN Commission of Inquiry appointed by the UN Human Rights Council in March 2013, recommended that the UN Security Council refer the situation in North Korea to the International Criminal Court (ICC) and that the UN High Commissioner for Human Rights carry out investigations.
    The report found that crimes against humanity were committed in North Korea over amulti-decade period "pursuant to policies established at the highest level of the State."
    Alleged crimes included "extermination, murder, enslavement, torture, imprisonment, rape, forced abortions and other sexual violence, persecution on political, religious, racial and gender grounds, forcible transfer of persons, enforced disappearance of persons and the inhumane act of knowingly causing prolonged starvation." With regard to freedom of expression, the report noted that "intensive state indoctrination occurs in an environment where the exercise of the right to express facts and opinions critical of the state or its official ideology is not tolerated…"
    A witness told the Commission told how he was discouraged since his youth by his parents from aspiring to become a writer as no one could write freely. In North Korea, he said that it is only permitted towrite about matters which put Kim Il-sung, Kim Jong-Il and the Workers’ Party of Korea in a good light. Writers who write beyond this remit are liable to be arrested and treated as political criminals.
    Media and related information are state-controlled:  it is illegal to listen to foreign radio, watch foreign TV or foreign videos.
    Local police ensure that radios for sale are pre-tuned to government stations and sealed before being sold. The media is heavily controlled and censored, and "forms the backbone of an enormous propaganda machine."
    Reading of books from the Republic of Korea is punishable as a crime of espionage. Chinese books are also prohibited.
    There is extensive wiretapping of telephones. Only the elite may own computers and use the Internet – permission only granted to visiting foreigners recently following a visit by Google, but still barred to the vast majority of North Korean citizens.
    Surveillance teams of inspectors raid homes (especially in towns and cities close to borders) to see if families are watching or listening to foreign films and radio or television broadcasts. People caught listening to foreign broadcasts are detained and sentenced to long prison terms.
    Article 48 of the Press Law empowers the State to criminalize any statement, publication, news or article that is critical of the State or its organs.
    Article 103 of the Penal Code stipulates that anyone seriously disturbing the social order shall be punished with up to 5 years of correctional labour and, in serious cases, their leaders shall be punished with up to 10 years of correctional labour.
    Such crimes include merely listening to broadcasts from the Republic of Korea, circulating printed matter from the Republic of Korea; and spreading unfounded rumours.
    But even worse - once people are in prison and labour camps, they disappear completely and often die there. A small number have been released and have escaped to tell their tales.

    The Assembly of Delegates of PEN International urges the government of the Democratic People’s Republic of Korea to:
    � Implement the recommendations in the UN Commission of Inquiry’s report,       and in the reports of the UN Secretary General and of the Special Rapporteur on the Democratic People’s Republic of Korea aimed at improving the situation of freedom of expression in the country;
    � Uphold the right of people in the Democratic Republic of Korea to peacefully exercise their right to freedom of expression;
    � Release immediately and unconditionally all individuals held solely for peacefully exercising that right
    � End the use of forced labour camps and to clarify the fate of all individuals sent to them;
    � Promote literacy and the act of creative writing as a fundamental and indivisible part of the right to freedom of expression. It also urges the international ommunity to:
    � Respect the principle of non-refoulement and not to return anyone to the Democratic People’s Republic of Korea who would be at risk of serious human rights violations, including crimes against humanity
    � Refer the situation in the Democratic People’s Republic of Korea to the International Criminal Court
    � To implement all the recommendations to the international community contained in the UN Commission of Inquiry’s report, and in the reports of the UN Secretary General and of the Special Rapporteur on the Democratic People’s Republic of Korea aimed at improving the situation of freedom of expression in the country;
